Consultation on the Business Rates Treatment of Self-Catering Accommodation

Minutes:

The Chair invited Mike Heiser, Senior Adviser, to introduce the item.  Mike stated that the report sets out the key points in the Government’s consultation concerning business rates treatment of self-catering accommodation and asks members for views on the LGA’s draft response.  Mike confirmed that the proposals are based on the process adopted in Wales in 2010.

 

Members made the following comments:

 

-       The Chair stated it is distinctly harder to transfer property from council tax on to business rates.

-       Members broadly agreed with the paper, and thanked officers for the information provided.

-       Members asked whether it was possible to look at the impact of the proposals on local authorities.  Mike Heiser stated that it depends on a number of factors such as the council tax band and the business rates rateable value which will differ case by case, so it would be difficult to carry out a table top exercise.

-        

-       Members discussed the NHS Trusts’ application to be considered charities for the purposes of business rates and legal proceedings on the valuation of ATM’s for the purposes of business rates bill, and how this will create funding changes.  Sarah Pickup, Deputy Chief Executive, stated that the LGA is following the progress of the NHS Trusts’ appeal and providing legal assistance.  Sarah also stated that the LGA is engaged with the Valuation Office Agency over the case concerning the rating of ATM’s.

 

 

The Chair thanked members for their comments, and confirmed that group leaders and lead members of Resources Board would sign off the consultation response.

-       Members agreed to the lines set out in the paper for the consultations response. 

-       Members noted the update.
